Treat Wallet, Inc., dba eGiftify, and its employees, contractors, managers and offers (collectively "eGiftify") is committed to the privacy of all Personal Data it holds and is committed to protecting and limiting the use of such information in accordance with applicable privacy laws. "Personal Data" means any information relating to an identified or identifiable natural person. eGiftify has adopted this Personal Data Privacy Policy to protect the individuals whose Personal Data eGiftify processes. The term "processing" is used in this Policy to cover all activities involving Personal Data, including, but not limited to: collecting, handling, updating, storing, deleting, sharing, accessing, using, transferring, and disposing of the Personal Data. This policy reflects the principles and standards on handling Personal Data and governs all eGiftify business activity and conduct of eGiftify employees, contractors and third parties with respect to Personal Data processed on behalf of eGiftify.

This information is collected at various places on our Services for instance, when you check out with your online order; engage with our mobile applications; email offers, and mobile messaging offers; Ticketing, Promo's, participate in surveys; Join Us; enter contests or sweepstakes; or interact with special-event or program offers.
We may also collect information that you provide on our Services about people you know or have opted-in to your Client List. For example, we collect your gift recipient's contact information to process your gift orders, send marketing offers and promo's, discounts, BOGO's via email or SMS.
We do not sell your personal information for the intents and purposes of the California Consumer Privacy Act (CCPA)

Cookies, Clear Gifs and Similar Technologies

You may remove yourself from the email list by following the removal instructions located at the bottom of each commercial email or by completing the unsubscribe form. If you have joined one of our Merchant Partner Join Us email lists, you may receive email from eGiftify or from the Merchant directly. If at any time you'd like to stop future delivery of eGiftify or Merchant email offers, simply follow the removal instructions located at the bottom of each email message. Opting out of any of these emails will not stop operational or transactional messages such as password-reset or account related information from the brand or line of business in question. We may occasionally provide you with the opportunity to opt in to receive email messages from third parties. If you do opt in, we'll share your e-mail address with the specific third party in question. Please review their privacy policies to see how they treat your personal information. -
Mobile Text Messaging
If you've signed up for mobile text messaging offers but later decide you no longer wish to receive these offers, simply reply STOP. -
Mobile Push Notifications/Alerts

eGiftify is a global organization. As the majority of our administrative and technical support functions are headquartered in the US we share, store and process personal information in the United States of America. Customers accessing and purchasing with our Services will be interacting with servers and services provided from within the United States of America.
When we transfer your personal information internationally we will take steps to ensure that your personal information is treated lawfully in the manner we describe in this privacy policy.

Please note that once you contact us by email, we may require additional information and documents, including certain Personal Data, in order to authenticate and validate your identity and to process your request. Such additional data will be then retained by us for legal purposes (e.g. as proof of the identity of the person submitting the request).
If you would like to make any requests or queries regarding Personal Data we process on behalf of our Customer's behalf (Merchant or Third Party), please contact the Merchant or Third Party directly. For example, if you are a User who wishes to access, correct, or delete data processed by eGiftify on behalf of a Customer (Merchant or Third Party), please direct your request to the relevant Customer (who is the Data Controller of such data. (See the following section "Data Controller/Processor")
Data Controller/Processor
We are the Controller of our Visitor's and Customer's Personal Data and certain types of User Data; we are the Processor of any Personal Data contained in Customer Data, and of User Data processed on behalf of our Customer.
Certain data protection laws and regulations, such as GDPR or the CCPA, typically distinguish between two main roles for parties processing Personal Data: the "Data Controller" (or under the CCPA, "business"), who determines the purposes and means of processing; and the "Data Processor" (or under the CCPA, "service provider"), who processes the data on behalf of the Data Controller (or business). Below we explain how these roles apply to our Service, to the extent that such laws and regulations apply.
eGiftify is the "Data Controller" of its Visitor's and Customer's Personal Data, as well as User Data consisting of contact details, as well as usage, preferences, engagement and analytic data. With respect to such data, we assume the responsibilities of Data Controller (solely to the extent under law), as set forth in this Privacy Policy. In such instances, our Service Providers processing such data will assume the role of "Data Processor".
If any of our Users upload or submit Customer Data or other content to our Service which includes Personal Data (e.g., by submitting their own client's contact details and other personal data to our system), such data will only be processed by eGiftify on behalf of our Customer, which is the owner of the respective relationship, along with all other User Data processed on such Customer's behalf.
In such instances, our Customer shall be deemed the "Data Controller" of such data, and eGiftify will process such data on the Customer's behalf, as its "Data Processor", in accordance with its reasonable instructions, subject to our Terms, our Data Processing Agreement with such Customer (to the extent applicable) and other commercial agreements. eGiftify's Service Providers shall act as designated Sub- Processors in these instances. The Customer will be responsible for meeting any legal requirements applicable to Data Controllers (such as establishing a legal basis for processing and responding to Data Subject Rights requests concerning the data they control).
